According to Video Cellar in this post mere restoration is not copyrightable.

It's the addition of new creative elements such as much music or title cards in the case of silent films that can be copyrighted. In the case of the restored version it does have new music and new title cards. Also at the bottom of the post he stated if you remove these new copyrighted elements then you are left with public domain.
